JAKARTA – To realize the prosperity of the people based on the dream of the nation, The Chairman of The House of Regional Representative of the Republic of Indonesia (DPD RI), AA LaNyalla Mahmud Mattalitti plans the 4P Concept, namely Public, Private, People and Partnership, as a joint involvement of the state, private sectors and the community.
The people’s position can’t be neglected as they become an absolute requirement for the strategic investments in regions.
This discourse was conveyed by LaNyalla virtually in the first Dies Natalis National Public Dialogue of Juris Polis Institute (JPI) at Jakarta, Sunday (20/3) afternoon.
Attending the dialogue titled ‘Reconceptualization of National Development Directions in Realizing the Nation’s Ideals’, were Chairman of MPR RI, Bambang Soesatyo, The Advisory Board of JPI, Ibnu Sina Chandranegara, Founder of Integrity Lawfirm, Denny Indrayana, College Executive Director of JPI, Ahmad Redy, Secretary General Mahutama, Aulia Khasanofa, the administrator of JPI and the dialogue participant.
“In the 4P Concept, the people must take part as the owner of the territorial sovereignty, or the natural resources in their regions. Hence, their involvement becomes an absolute requirement for a strategic sector investment,” explained this senator from East Java.
He added, the concept of involving the People in Public, Private, People and Partnership is different from the CSR companies for the surrounding communities.
“The CSR we know is just alms, or even bribery for the surrounding communities,” he replied.
The 4P Concept has fundamental meaning as a space and access for the people to be part in managing the natural resources in regions so that it is truly beneficial for their welfare.
“If the people are not given the access and space to manage the natural resources in their regions, some private parties or even individuals will conduct some resource depletions,” he asserted.
This concept is in accordance with the thoughts of the founding fathers of the nation as stated in Article 33 Paragraphs (1), (2) and (3) of the 1945 Constitution.
Because in the Explanatory Chapter of the Original Manuscript Constitution, the meaning of ‘The economy structured by joint venture of the kinship principles’ is the economy from the people for the people.
“The used word is ‘structured’, not ‘composed’. Because both of them are very different. Structured means it is designed by the clearly planned rules and regulations. In contrast to the word composed which means it is left to arrange itself, or in the other word is left to the market mechanism” he explained.
As well as the sentence “…joint venture…” which means a symbiotic mutualism that is very different from the private sector which is dominated by the principle of self-interest and profit accumulation.
“While the sentence of “…controlled by the state.” means the state is present with the policies, management, regulation, management and supervision, for the purpose of the people’s prosperity,” he continued.
Therefore, the essence of the basic principle of Article 33 The 1945 Constitution of the Republic of Indonesia must be re-established by this state.
The first is the principle of an economic system on the basis of kinship.
Second, the principle of economic democracy, while the third is the principle that those branches of the economy which are important to the state and which concern the livelihood of the people are controlled by the state and must be used for the prosperity of the people.
“Wherein ideally the Indonesian economy is structured and run by three entities that support and protect each other. They are Cooperatives or People’s Enterprises, BUMN or BUMD and BUMDes, and pure private companies, both national and foreign,” he said.
Only the companies that don’t hold the livelihood of many people are allowed to be owned by individuals.
Meanwhile, the Earth, Water and Natural Resources contained in the earth are the main points of people’s prosperity.
Therefore, it must be controlled by the state and used for the prosperity of the people.
“And the 4P Concept which is Public, Private, People, Partnership is an absolute way out to achieve the dreams of the founding fathers of the nation, which ends in Social Justice for All Indonesian People,” he said.
He added that the concept of state control over natural resources is based on state sovereignty.
Because sovereignty is the supreme power of the state to freely carry out activities according to its interests, as long as it does not violate the sovereignty of other countries.
“The international legal norms highly respect the territorial sovereignty of a country, including the national interests of a sovereign state. Therefore, there is no obligation to follow or obey the international instructions that violate our national interests as a sovereign state.” he concluded.
